These Terms of Service (the “Terms”) are a template meant to be production-ready, but they’re not legal advice. You should have counsel review them for your jurisdiction and business model.
1. The agreement
By creating an account, purchasing a subscription, or using AnswerCheap (the “Service”), you agree to these Terms and our Privacy Policy.
2. Who may use the Service
You must be legally able to enter a binding contract in your jurisdiction. If you use the Service on behalf of a company, you represent that you have authority to bind that company.
3. Your responsibilities
- Lawful recording and consent: You are responsible for complying with call recording laws, consent requirements, and notice obligations that apply to you and your callers.
- Accurate configuration: You are responsible for configuring your telephony provider (for example, Twilio) to route calls correctly to the Service.
- Acceptable use: You will not use the Service to violate laws, infringe rights, harass others, send illegal spam, or attempt to bypass safety controls.
- No emergencies: The Service is not designed for emergency calling (for example, 911, 112, 999) and should not be used to handle emergency or life-critical communications.
4. AI features and limitations
The Service uses AI to generate and interpret content (for example, call transcripts, summaries, lead extraction, and automated actions). AI output may be incorrect, incomplete, or inappropriate. You are responsible for reviewing results and making decisions based on your own judgment.
5. Customer content
You retain ownership of your content, including call audio (where applicable), transcripts, summaries, and metadata (“Customer Content”). You grant us a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Service.
You represent and warrant that you have all rights necessary to provide Customer Content to the Service, including permissions required for recording and processing calls.
6. Third-party services
The Service integrates with third-party providers (for example, telephony, AI, payments, and infrastructure). Your use of those providers may be subject to their terms and privacy policies. We are not responsible for third-party services.
7. Billing
Subscriptions may include base fees plus usage-based charges (for example, minutes processed). You authorize us (or our payment processor) to charge your payment method for recurring fees and applicable usage. Taxes may apply.
Unless required by law, payments are non-refundable. You can cancel future renewals in your Billing settings.
8. Suspension and termination
We may suspend or terminate access if you violate these Terms, create risk for the Service, or if required by law. You may stop using the Service at any time.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
11. Changes
We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
